General terms and conditions of sale

Definitions:

These General Terms and Conditions of Sale (hereinafter referred to as the GTCS) are those of LES BRISES (hereinafter referred to as the Company), registered in the La Rochelle Trade and Companies Register under number 309 674 356 00030, whose registered office is located at Chemin de la Digue Richelieu 17000 La Rochelle, France (telephone +33 5 46 43 89 37)

The Company is the owner and publisher of the vertime-lessables.com website, which is hosted by OVH, a company registered with the Lille Métropole Trade and Companies Register under number 424 761 419, whose registered office is at 2, rue Kellermann 59100 Roubaix (telephone 09 72 10 10 07).

The publication director is Mr Nicolas Schmoll.

The site offers the Customer (hereinafter the Customer) the possibility of reserving and paying for rooms at Vertime (hereinafter the Services).

The official language of the site is French; an English version is also available.

Application of the GTC:

The purpose of these GTC is to define the terms and conditions for marketing the hotel's Services and apply to any order (hereinafter the Order) placed on the site by the Customer.

Validation of the Order by the Client implies acceptance of the GTCS. The Client declares that he/she has received all the information required to place the Order on the Company's website.

Ordering Services on the site:

The Customer books the Service(s) that suit him/her on the website. The Services are described and presented in a precise manner on the Company's website. At any time, the Customer may check the amount of his/her Order. The Customer is responsible for his/her choice of Services.

The Customer may modify his/her Order until it has been validated. The Order summary lists the Services ordered and their prices, including any additional charges (tourist tax).

At the end of the Order, the Customer confirms acceptance by ticking the box to validate the General Terms and Conditions and then clicking on 'Confirm my booking'. Certain 'Non-modifiable, non-cancellable' offers require explicit acknowledgement of the obligation to pay for the Order online.

Once the Order has been confirmed, the Company will send an e-mail confirmation to the Customer setting out the details of the booking.

Terms of payment for the online Order

The prices of the various Services are given in the descriptions and are in Euros, inclusive of all taxes. Unless otherwise stated or special offers are made, ancillary services are not included in the price (breakfast, etc.)

For online payments, the Site uses a secure transaction system called STRIPE, which guarantees the confidentiality of the Customer's bank details.

The data is totally encrypted and protected and is not stored electronically by the Company.

The Company reserves the right to suspend or cancel any Order in the event of non-payment, fraud or attempted fraud.

Right of withdrawal:

In accordance with Article L 221-28 of the French Consumer Code, the Customer acknowledges that the right of withdrawal does not apply to the provision of hosting services and therefore expressly waives any right of withdrawal by accepting these GTC.

Processing of personal data

In the course of its business, the Company is required to process certain personal data of its Customers. The Company attaches great importance to respect for privacy and takes all necessary measures to ensure the confidentiality and security of Customers' personal data.

The Company collects personal data and in particular the following information:

  • Email address
  • First name and surname
  • Postal address
  • Telephone numbers
  • Bank details (credit cards)

The Customer consents to this data being processed and analysed for the following purposes:

  • Site management
  • Management of orders
  • Payment of orders
  • Answering questions or complaints
  • Managing and sending the newsletter
  • Compilation of statistics
  • Management of requests for rights of access, rectification and opposition
  • Management of unpaid invoices and disputes

Customers' personal data is kept for the time strictly necessary for the above purposes, up to a limit of three years after collection or the last contact with the Customer.

The Company may need to communicate Customers' personal data in order to cooperate with the administrative and judicial authorities.

Pursuant to Decree 2011-219 of 25 February 2011 relating to the retention and communication of data identifying any person who has contributed to the creation of content placed online, the Customer is hereby informed that the site host is obliged to retain for a period of one year from the date of creation of the content, namely:

  • The connection identifier at the origin of the communication
  • The identifier assigned by the information system to the content concerned
  • The protocols used to connect to the service
  • The nature of the operation
  • The dates and times of the operation
  • The identifier used by the author of the operation

The Company collects the IP address of each computer used by Customers in order to analyse site traffic and to check that it is not carrying out acts likely to harm the Company's interests.

In accordance with the French Data Protection Act of 6 January 1978 and any regulations amending or replacing it, Customers have the right to access, rectify, delete and object to the processing of their data collected and processed by the Company, by contacting the Company directly at the following email address hello@vertime-lessables.com

As part of the use of the site by Customers, the Company may use cookies. An alert message asks each person visiting the site whether they wish to accept cookies beforehand. These cookies do not contain any confidential information about Customers.

Applicable law and jurisdiction

These GCS shall be governed by and construed in accordance with French law. In the event of a dispute concerning the interpretation or performance of these GCS, the Customer and the Company shall together seek an amicable solution to the dispute.

If they fail to do so within 30 days, the parties may refer the matter to the courts at the Company's registered office.
